OUR MISSION
We are dedicated to enlightening the parties in dispute about the functioning and advantages of the system and ensuring that they establish communication in order to resolve private law disputes at national and international arenas through mediation, which is an alternative dispute resolution method, making sure that both parties reach resolutions suitable for their interest within the principles of privacy in an economic way within earliest convenience in an amicable and permanent manner in our independent and impartial center, established specifically for mediation activities with our mediators who are experts in their fields.

OUR SERVICES

LEGAL ACTION REQUIREMENT ON COMMERCIAL CASES (MANDATORY MEDIATION)

Commercial mediation services. They offer an alternative way of out-of-court settlement available to individuals. Mediation is in place in Turkey with respect to labour disputes and it has yielded quite successful results and continues to do so.


Article 5/a of the Turkish Commercial Code No. 6102 prescribes that any legal action to be lodged for the payment of a certain sum in terms of claims of receivables and damages among all commercial actions specified in Article 4 of the Turkish Commercial Code and also commercial actions prescribed by other private laws must initially be brought to a mediator before having recourse to such legal remedy. In other words, such legal action may not be lodged directly before any commercial court of first instance without first having recourse to a mediator.

 

 

MEDIATION IN LABOUR DISPUTES

An employer and an employee acting as parties to a legal dispute must first apply to a mediator as a mandatory precondition. Labour actions lodged before a labour court without fulfilling such requirement will be dismissed on the procedural grounds of “absence of legal action requirement”.

MEDIATION SERVICES

A mediator concludes an application within 3 weeks following their appointment. This timeframe may be extended, as and when needed, by a mediator for a maximum period of 1 week.
